Qualifying for an Uncontested Divorce in California

In California, uncontested divorce is also known as a summary dissolution. With an uncontested divorce, either you and your spouse agree on all aspects of the divorce, including property division and parenting issues, or your spouse does not disagree with your decisions and will likely not file any complaints in court.

Requirements for an uncontested divorce in California include:

  • One spouse has been a California resident at least six months
  • One spouse has been a resident of the county at least three months
  • There are no minor children
  • Neither spouse is pregnant
  • The marriage lasted less than five years
  • Neither spouse has real property
  • Unpaid debts do not exceed $6,000
  • The couple's marital assets total less than $38,000
  • All assets and debts are settled
  • Neither spouse is seeking alimony

You will need to sign all relevant documents and review the summary dissolution information booklet so you understand what to expect and what is expected of you.
