Modifications of Child Custody

In California, a custody modification can be requested by either parent at any time. A modification may be requested for a variety of reasons, but the most common reason is to accommodate a change in circumstances. For example, if a parent is no longer able to care for a child due to a job change or a military reassignment, they may request a change in the child custody arrangement. Another common reason that parents request a custody modification is to change the parenting time schedule. Parents may also request a change in the schedule to accommodate their changing work or school schedules, or to provide more time with their children during the summer months.

Parents should be aware that a custody modification is not automatic. The court will carefully consider the facts and circumstances of the case and determine whether a change in the custody or parenting time arrangement is in the best interest of the child. Parents will need to show the court that a change is necessary to meet the needs of their child.

While parents can request a modification on their own, it is always best to have the assistance of an experienced Carlsbad modification attorney by your side when doing so. An attorney can help you gather the necessary information and evidence you need to present a compelling case to the court as well as negotiate with the other parent on your behalf.

Modifications of Child Support

Parents who are receiving child support payments can also request a modification of their support obligation. While the court will consider the same factors when deciding whether to grant a modification as it would in a custody case, the most common reason for a modification is a change in income.

Parents who are experiencing a decrease in income or an increase in expenses may request a reduction in their child support obligation. Parents can also request a change in the payment schedule, such as asking for more frequent payments to accommodate their increased work schedule or asking for fewer or more spread-out payments to accommodate their increased or decreased income.

Similar to child support modifications, requests to modify child support are not always granted.
